TERMS AND CONDITIONS
MACHO HALISI LTD is a class A tour operator licensed by TALA. As a company we are bound to uphold the high standards of tour operating and client care as set out by the charter of TALA.
These booking conditions apply to any booking that you make with us, so you should read them carefully. Please note that it is the laws and regulations of the country in which services are provided, which apply to your holiday arrangements and not those of your home country.
PAYMENT AND REFUND POLICY
A minimum deposit of 45% of the total price is required at the time of booking, and the balance no later than 60 days prior to departure of the tour. For overseas bookings and non-residents of Tanzania, payments should be in US Dollars or Euros. Residents may pay in local currency at the rate or exchange applicable at the time of payment.
MACHO HALISI LTD reserves the right to withhold all or part of the service (at its sole discretion) if any payment is not received in accordance with the above conditions. Payment is required in full for bookings that are made less than sixty (60) days before the start of your trip. Any additions to your reservation made within sixty (60) days of commencement of your trip may be accepted provided space is available, payment in full is received, and documentation is finalized before the commencement of your trip. MACHO HALISI LTD reserves the right to accept or reject any booking during this time frame at its sole discretion.
LATE BOOKINGS
Payment is required in full for bookings that are made less than sixty (60) days before the start of your trip
MODIFICATION OF TOUR
If you choose to modify the arrangements after the commencement of the tour i.e. change accommodation or the duration of your stay, the company can accept no liability for any loss or additional expense incurred and no refund will be made.
CANCELLATION OF TOUR
• It is a condition of travel that all clients have comprehensive trip cancellation, medical and evacuation coverage.
• Prices are subject to change without prior notice due to changes beyond our control –such as, but not limited to– increases in statutory taxes, fuel costs, internal air ticket and charter prices or fees.
• There is no refund for unused services.
• Payment of deposit indicates acceptance of terms and conditions.
Booking Conditions:
To secure reservation – 45 % of total cost of the safari is payable within 7 days of booking.
Full payment is due 60 days prior to departure.
Cancellation Fees:
Up to 60 days before departure 45% (Booking Fee) is forfeited
59 – 35 days before departure 50% of safari cost is forfeited
34 – 15 days before departure 75% of safari cost is forfeited
14 days or less before departure 100% of safari cost is forfeited
Mt. Kilimanjaro / Meru Climbs:
Cancellation between 35 days to arrival date — 100% of the total cost will be charged
Cancellation during the climb:
In the unfortunate event that a client is unable to complete the ascent or needs to be brought down the mountain for any reason including illness or injury there will be no refund for unused services.
Refund will not be provided if parts of the service/ climb are not utilized.
Client(s) will be responsible for any bank transfer charges; Macho Halisi Ltd must receive the full amount of the invoice. The price quoted is based on the current park entry fees. If these fees change the cost of the itinerary will go up accordingly.
Prices quoted in Euro’s might change depending on the exchange rate of the US Dollar

SPECIAL REQUESTS
MACHO HALISI LTD must be advised in writing of any special requests, such as dietary needs ,food or other allergies when you submit your reservation. This will ensure that our arrangements are to your satisfaction. MACHO HALISI LTD will attempt to meet any such requests, whenever possible but cannot guarantee them. Certain special requests may require procurement costs, which will be charged to your account. Any such charges will be communicated to you at the earliest opportunity.
ITINERARIES
Demand for safaris can be high and may lead to shortage of lodge/hotel accommodation. All bookings will be confirmed, but on occasion changes may be necessary. Hotels/lodges/camps mentioned on itineraries are given as an indication of the category and rooms may be reserved at similar lodges/hotels/camps. We undertake to advise you of any changes known to us prior to departure, but the possibility of change without notice, must be acceptable when booking.
Four-wheel drive vehicles will be provided according to the route and number of participants. MACHO HALISI LTD reserves the right to employ the services of subcontractors. English speaking driver/guides are provided. Occasional mechanical problems, changes of lodge or adverse road conditions may in turn lead to a change of routing or game viewing without prior notice being given. We reserve the right to offer substitutes of equal value or to cancel the operation of any tour. In practice, very few itineraries are affected but a little flexibility on your part will ensure the tour is unique and rewarding.
ACCOMMODATION
Accommodation is provided on twin/ double sharing self contained rooms, cottages or tents basis in most cases where available. We also try to provide Full Board Accommodation or Packed/ Picnic Meals while on journey between different locations. Single rooms, Children sharing room with parents or separate rooms, may be available with the payment of a supplement fee.
MODE OF PAYMENT
Payments are made via Telegraphic Bank Transfer to MACHO HALISI LTD bank account (to be provided on confirmation of booking) and subject to bank charges at the prevailing rates. The client is responsible for all bank charges and the full invoiced amount must be received in our account. We do not accept Traveler’s Cheques. In the case of walk in clients, cash US Dollars or Tanzanian Shillings will be accepted at the current dollar-buying rate.
TOUR PRICE INCLUSIONS
The prices quoted are inclusive of accommodation, meals as indicated in the itinerary (usually full board), transportation, park entrance fees and permits where applicable and services of a professional safari driver-guide.

LIABILITY
1. When you make a booking you guarantee that you have the authority to accept the terms and conditions on behalf of your party. A contract will exist as soon as we issue our confirmation invoice. This contract is made on the terms of these booking conditions which are governed by the Law of the United Republic of Tanzania and we both agree to submit to the jurisdiction of the Tanzanian Courts at all times.
2. MACHO HALISI LTD (hereafter referred to as the Company) is insured against legal liabilities arising from injuries that might be received by passengers while inside vehicles. You are, however, strongly advised to takeout your own insurance against the risk inherent in traveling in less developed areas especially as there may be time when your tour visits remote regions without means of rapid evacuation or medical facilities. Please remember that your supplier does not undertake to provide such assistance at its expense hence our strong recommendation to provide such assistance to cover such eventualities.
3. The Company and its agents act only as agents of the passenger in all the matters relating to hotel accommodation, sightseeing, tour and transport whether by aircraft, rail, motor coach, ship, boat or any matter howsoever except when the passenger is being carried in transport owned by the Company.
4. The Company’s obligations apply to those services that they agree to provide on your behalf. We cannot be held liable for any third party arrangements you arrange in conjunction on your own. For example we cannot be held liable if you miss your tour departure because you fail to arrive at the departure point at the agreed time.
5. The Company’s liability to passengers carried in its own vehicles is governed by the laws of the respective country in which services are provided and no other country, and all claims are subject to the jurisdiction of the courts of the respective country in which the services were provided.
6. The Company reserves the right to employ subcontractors to carry out all or part of the services agreed to be supplied and in the event of such right the terms to the clause relating to the Company’s liability shall apply.
7. Whilst every care is taken, the Company cannot be held responsible for the loss or damage of your possessions. It is therefore advisable to affect separate baggage insurance.
8. It is unlikely that we will have to make changes to your journey arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you at the earliest possible date. We also reserve the right in any circumstances to cancel your journey arrangements and to change an itinerary, accommodation or arrangements should it be necessary. The right is also reserved to decline to accept or retain any person as a member of any tour at any time in which event a reasonable refund will be made.
9. If you have a problem during your holiday, please inform the MACHO HALISI LTD representative immediately who will endeavor to put things right. If your complaint is not resolved in Tanzania, please follow this up within 28 days of your return home by writing to our Customer Services Department, P.O.BOX 60,Karatu, Arusha Tanzania or email us through the e-mail addresses , giving all relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.
10. Your contract is with MACHO HALISI LTD—registered office P.0.BOX-60-Karatu, Arusha, Tanzania, a limited liability company based in the United Republic of Tanzania conforming to all laws and regulations of the United Republic of Tanzania. All bookings shall be governed by, construed and interpreted in accordance with the laws of the United Republic of Tanzania and shall be subject to the exclusive jurisdiction of the Tanzanian Courts.
11. Our safaris and/or mountain climbs involve travelling in some of the more remote areas of East Africa where wild animals such as elephant, buffalo, hippo, lion, leopard, hyena, crocodile and other reptiles roam. Many services common in your home area (such as communications; telephones; medical assistance; evacuation in the face of danger, illness or injury; ground, water or air transport etcetera) may be unavailable or provided at a lower standard than that available to you in your home country. The standard of roads, for example, can be such that travel is impossible during or after heavy rain or floods. In many areas it is not possible for an aircraft to land at an airstrip at night, even in a medical emergency.
12. Anyone climbing a high mountain in Africa is hereby made aware that often there is a rapid gain in altitude over a few days. For example, on Mt Kilimanjaro the highest mountain in Africa, the trek starts from about 7,000 ft (2100 m) above sea level and culminates at 19,340 ft (5895,m) a few days later. The combination of heat, strenuous exercise and being at high altitude is a formidable one, which should not be taken lightly. There is a risk of dehydration and contracting altitude sickness, such as cerebral or pulmonary oedema, both lift-threatening diseases. In cases of sever acclimatization difficulties a climber may be advised by the guide to descend, rather than continue a summit bid. In such cases the advice of the guide should always be heeded. There are parts of the climb, such as the western breach, which are exposed and strenuous. In cases of injury or any other health problem, the nearest health facility can be a couple of days hike away. It is not possible to arrange an air rescue on Mt Kilimanjaro, and the nearest airport is Moshi airport, which is off the mountain.
13. Whilst every sincere effort is made to minimize the risks without losing the essential flavor of adventure, it is clear that some risk remains, for which the organizers cannot be expected to assume responsibility. Accordingly, NEITHER MACHO HALISI LTD NOR ITS EMPLOYEES, SUB-CONTRACTORS, SUPPLIERS, SERVANTS OR AGENTS WILL ACEPT LIABILITY FOR ANY LOSS, INJURY, DAMAGE OR DEATH, however arising while you and/or your family and/or guests are on the climb and/or safari, or other journey including your stay in camps and lodges. Nor will they be responsible for any loss, injury, damage or death before or after the climb or safari for which they have made bookings for you for ACCOMMODATION, TRANSPORT, SAFARIS, or any other extras. These exclusions of liability do not apply if loss, injury, damage or death was directly caused by willful misconduct or gross negligence by the management of MACHO HALISI LTD or of a supplier for which MACHO HALISI LTD is legally responsible. The entire liability shall in any event be limited to USD 5,000 per person.
REMITTANCE OF DEPOSIT SIGNIFIES ACCEPTANCE OF THESE TERMS AND CONDITIONS INCLUDING LIABILITY WAIVER IN SECTION 13.
