1. General
1.1. Mukisa Safaris Uganda organizes for you tour expeditions in Uganda and Rwanda. In these terms and conditions, "you" and “your(s)” means all persons named on the booking form/contract (including anyone who is added or substituted at a later date) while “company”, "we" and "us" means Mukisa Safaris Uganda.
1.2. You are kindly advised to read these terms and conditions, as your confirmation of conducting your tour expedition/safari with us implies that you have fully read and understood the same.
2. Application of these terms and conditions
2.1. Your travel with us or your contract with us in respect to your expedition/safari and all bookings are subject to these terms and conditions. For the avoidance of doubt, these terms and conditions shall always be read and taken to form part of your contract with us and all transactions with us.
3. Communications and documents
a) All communications by the Company in relation to your safari will be sent to you from our official mail
[email protected]. We will only reach you using our alternate mail of
[email protected] when we have technical issues with our web-mail. On receipt of your inquiry/request to organize for you a tour expedition, we will support our confirmation of receipt of your inquiry with a confirmation telephone call using the company’s official telephone numbers+256785234357 and +256754398378.
b) All documents including your invoices, contract with us and receipts shall be made on the company’s document papers and shall bear the company seal.
c) The company shall not assume liability for any losses you may incur as a result of failure to transact with us in compliance with the above communication procedure.
4. Payments to us
a) All payments must be made directly to the company; either to the company’s account through Telegraphic Transfer, RTGS or by cash.
b) The company will consider you booked for the safari upon payment of at least a deposit of 25% of the total trip cost. The balance of 75% should be paid within 60 days from the date of start of your safari.
c) Any safari that involves Gorilla and Chimps tracking will require you pay the necessary permit fees at the time of booking. This implies that the sum of the initial deposit of 25% will be increased where the safari involves gorilla and chimps tracking.
d) Any Safari booked within a period of less than 60days requires 100% payment and will only be confirmed upon receipt of the entire sum of the tour price.
e) Our safari prices are quoted in US dollars and the company operates a US Dollars account. It is desirable that payments are made in US dollars.
f) The person who signs the booking form and the contract guarantees payment of the total amount shown on the booking form in accordance with these conditions. It is the responsibility of the signatory to ensure the Company receives payment in full by the due date.
g) The Company reserves the right to refuse a booking or cancel the Safari without giving any reason and shall in that event return any money received in accordance with our terms on refunds mentioned herein.
h) The company reserves the right to increase the prices quoted should circumstances warrant that an increment is desirable for successful execution of the safari
5. Cancellations by you and by the company, and any incidental refunds.
5.1 Cancellations by you
Should any member of the Safari team be forced to cancel, you should communicate to us in writing. A cancellation is not effective until we receive a copy of your written notice. Below are the charges and corresponding refunds:
a) 60 days prior to date of arrival 25% Charge
b) 45 –59 days prior to date of arrival 40% Charge
c) 31 – 44 days prior to date of arrival 50% charge
d) 0 – 30 days prior to date of arrival 100% charge
e) All charges shall be computed after deducting any money expended to authorities and service providers to cater for any bookings. This may include but not limited to permits for chimps and entry into parks, deposits to carriers and transporters, legal fees and hotel bookings.
f) No refunds will be made for any unused services, late arrival or no-show of any of the members of the tour.
5.2. Cancellations by the company
a) Rarely will the company cancel confirmed bookings. The company will always endeavour to avoid cancelling, however the company reserves the right to do so. We shall not cancel your confirmed safari/tour unless we are forced to do so as a result of unusual and unforeseeable circumstances beyond our control.
b) Cancellations occasioned by Force Majeure or any Acts of Godwill certainly amount to frustration of the safari. In such event, we shall offer you an alternative safari of a similar standard to that originally booked if available. If the chosen alternative is less expensive than your original safari we shall refund the difference but if it is more expensive, we shall ask you to top up.
c) Where you opt for a refund, we shall compute any expenditures incurred and any deposits made to service providers, any money paid to Authorities including charges, fees, levies and permits, and will thereafter make a refund.
d) We regret we cannot pay any compensation for expenses, costs or losses incurred as a result of any cancellation. We advise that you obtain travel insurance to offer you cover against such eventualities.
6. Your obligations
a) It’s your duty to equip yourself with all documentation and relevant material to enable you travel to and within the country of your safari choice. It is advisable that you obtain further counsel from your travel advisors/agencies for purposes of acquainting yourself with the necessary information that will guide you as you embark on your safari. The company shall not be bound for any denials of entry or stay in the country of your safari choice.
b) Any special dietary or medical conditions should be communicated to us at the booking of your safari.
c) Your safety while on safari is paramount. We advise that you take caution and follow instructions from the guides and rangers to avoid harm or injury.
d) You are expected to conduct yourself in a manner that will not attract any civil or criminal sanctions while on your safari. The company reserves the right to terminate your safari with the company should your behavior cause inconvenience to other members on travel or even to the ecosystem.
7. Execution of the Safari and Liability of the company
Whilst the company will make every effort to ensure that you have a successful travel expedition, and that all arrangements and services connected to the safari are carried out in the most efficient and effective way possible, the company does not assume liability arising from the following:
a) Failure to obtain game viewing as desired. The company will ensure that you are taken to the known spots for obtaining the desired viewing but has no direct control over wild animals and therefore assumes no liability for any failure to view animals as may be desired.
b) Whilst every supplier is chosen with utmost care, the company does not assume liability for errors or omissions of such suppliers. These independent contractors include transporters who may be sourced to transport you to your safari destinations, hotels for your accommodations, boat owners and any other supplier of services on your safari.
c) Every effort is made to ensure that vehicles are provided in a roadworthy condition but no liability can be accepted for breakdown, or any damage or delay.
d) The company shall not be liable for any loss, damage or injury of any nature whatsoever whether to person or property.
8. Disclaimer
The Company has made all reasonable efforts to check the accuracy of the information contained in our website. The Company cannot however accept any responsibility for any errors or omissions that may appear in the company website.
9. Dispute resolution and Governing Laws
Any dispute that may arise from any contract with the company shall initially be resolved by mutual discussions and reconciliation. Where reconciliation fails, parties shall refer the matter to an authorized arbitrator in Uganda.
The Laws of the Republic of Uganda shall govern any safari arrangements with the company.
