Terms and Conditions for Venny Travels Limited (2024)
Effective Date: January 1, 2024
These Terms and Conditions govern all bookings, services, and transactions with Venny Travels Limited. By engaging our services, you agree to comply with the following terms:
1. PRICING AND RATES
1.1 All rates are subject to change without prior notice in case of significant currency fluctuations, changes in government regulations, taxes, or unforeseen circumstances.
1.2 Rates quoted are inclusive of applicable taxes unless otherwise stated.
1.3 Any pricing adjustments due to government-imposed taxes or levies will be communicated in writing and applied immediately.
2. BOOKINGS AND RESERVATIONS
2.1 Bookings are confirmed only upon receipt of a signed agreement or payment of the required deposit.
2.2 For group bookings, room allocations are held based on a release period schedule as follows:
Peak Season: 60 days before arrival
High Season: 60 days before arrival
Low Season: 45 days before arrival
2.3 Late booking requests will be accommodated based on availability and may incur additional charges.
3. PAYMENT TERMS
3.1 A non-refundable deposit of 20% is required for all confirmed bookings:
For travel between 15th December 2023 – 31st March 2024, payment is due by 15th September 2023.
For travel between 20th June – 31st October 2024, payment is due by 15th March 2024.
3.2 Full payment is required 30 days before travel or service delivery.
3.3 Failure to pay within the stipulated timeline will result in cancellation without refund.
3.4 Disputes on invoices must be raised within 14 days of issuance; only the disputed amount may be withheld pending resolution.
3.5 Payments must include a remittance advice detailing the invoice being settled.
4. CANCELLATIONS AND REFUNDS
4.1 Cancellation fees will apply as follows for accommodation or tour cancellations:
60–46 days before arrival: 20% of total costs charged.
45–36 days before arrival: 35% of total costs charged.
35–31 days before arrival: 50% of total costs charged.
30 days or less/no-shows: 100% of total costs charged.
4.2 Refunds, if applicable, will be processed within 14 business days after confirmation.
5. ITINERARIES AND SERVICES
5.1 Venny Travels Limited reserves the right to modify itineraries or services due to unforeseen circumstances such as weather, political instability, or operational requirements.
5.2 Clients will be informed of any changes at the earliest opportunity.
6. TRAVEL DOCUMENTATION
6.1 Clients are responsible for ensuring they have valid passports, visas, and travel permits.
6.2 Venny Travels offers visa assistance but does not guarantee approval by the issuing authority.
6.3 It is the client's responsibility to check the entry and health requirements for their destination.
7. LIABILITY
7.1 Venny Travels Limited acts as an intermediary between clients and service providers (airlines, hotels, transport companies, etc.). The company is not liable for acts or omissions of these providers.
7.2 The company is not responsible for loss, damage, injury, or delay caused by events beyond its control, such as natural disasters, strikes, or government actions.
7.3 Clients are encouraged to purchase comprehensive travel insurance to cover unforeseen risks.
8. CONFIDENTIALITY
8.1 All bookings and agreements are confidential and must not be shared with third parties without prior consent from Venny Travels Limited.
9. COMPLIMENTARY POLICY
9.1 For group bookings, one tour leader will receive complimentary accommodation for every 15 full-paying clients, provided the accommodation is pre-booked.
9.2 Complimentary arrangements will be reflected in the total invoice.
10. FORCE MAJEURE
10.1 Venny Travels Limited is not responsible for service disruptions caused by force majeure events, including but not limited to natural disasters, government actions, pandemics, or strikes.
11. CUSTOMER CONDUCT
11.1 Clients must comply with all local laws, regulations, and customs in their travel destination.
11.2 Any misconduct or unlawful behavior may result in termination of services without refund.
12. GOVERNING LAW
12.1 These Terms and Conditions shall be governed by the laws of the Republic of Kenya.
12.2 Any disputes arising from these terms will be resolved through arbitration in accordance with Kenyan law.
