Terms and Conditions for Paradise Vacations Safari Tours
1. Booking and Payment
Booking Confirmation: A booking is considered confirmed once a 30% deposit is received, with the remaining balance due 30 days before the departure date.
Payment Methods: We accept payments via bank transfer, mobile payment, or credit card. All payments must be made in the currency specified at the time of booking.
Price and Availability: Prices quoted are valid at the time of booking but may be subject to change due to factors such as exchange rate fluctuations, park fee increases, or changes in accommodation costs.
Booking Amendments: Any changes to your confirmed itinerary are subject to availability and may incur an administrative fee.
2. Cancellations and Refunds
Client Cancellations:
Cancellations made 30 days or more before the tour departure date will incur a 10% cancellation fee.
Cancellations made within 29 to 15 days will incur a 50% cancellation fee.
Cancellations made less than 14 days before departure will result in no refund.
Operator Cancellations: If Paradise Vacations cancels a tour due to unavoidable circumstances (e.g., safety concerns, natural disasters), clients will receive a full refund or the option to reschedule.
Refund Process: Refunds will be processed within 30 days, subject to the relevant deductions as per the cancellation policy.
3. Safari Itinerary and Services
Safari Changes: We reserve the right to alter safari itineraries due to unforeseen circumstances, including weather conditions, safety issues, or wildlife-related changes. Clients will be informed of any significant changes.
Park Fees and Other Costs: All park entrance fees, government taxes, and levies are included unless specified otherwise. Any additional services requested by the client, such as extended stays, extra game drives, or additional activities, will incur an extra charge.
Minimum Numbers: Some tours require a minimum number of participants to proceed. If the minimum number is not met, we may offer a full refund or an alternative tour.
4. Health, Safety, and Travel Insurance
Health Requirements: It is the client’s responsibility to ensure they are medically fit for travel and to inform us of any medical conditions that may affect their participation in the tour.
Travel Insurance: We strongly recommend that all clients obtain comprehensive travel insurance that covers cancellation, medical emergencies, evacuation, and lost luggage.
Safety Standards: We adhere to the highest safety standards on all tours, including the use of licensed and experienced guides, well-maintained vehicles, and adherence to all local regulations. Clients must follow the guide’s instructions during the safari to ensure their safety and the safety of others.
5. Liability
Limitation of Liability: Paradise Vacations is not responsible for any loss, injury, or damage incurred during the tour, except as a result of negligence on our part. Clients participate in activities at their own risk.
Force Majeure: Paradise Vacations shall not be held responsible for any delays, cancellations, or changes due to events beyond our control, including natural disasters, strikes, or political instability.
6. Client Responsibilities
Behavior and Conduct: Clients are expected to behave responsibly and respectfully towards other participants, staff, wildlife, and local communities. We reserve the right to remove any client from the tour whose behavior is disruptive or unsafe.
Wildlife Interaction: Clients must follow all park rules and guidelines regarding wildlife viewing. Feeding, disturbing, or attempting to touch wildlife is strictly prohibited.
Respect for Local Culture: Clients are encouraged to respect the cultural norms and customs of local communities visited during the tour.
7. Travel Documents and Visas
Documentation: It is the responsibility of the client to ensure they have the necessary travel documents, including valid passports, visas, and vaccinations (if required), for entry into Kenya or other destinations.
Visa Requirements: Clients should check the visa requirements of the countries they are visiting and ensure they have the correct documentation prior to travel.
8. Privacy and Data Protection
Client Data: Paradise Vacations values client privacy and ensures that personal information is stored securely. We will never share your personal data with third parties without your consent, except as necessary to complete your booking (e.g., with accommodation providers or park authorities).
Marketing Communications: By booking with Paradise Vacations, clients agree to receive communications regarding their booking, future promotions, and special offers. Clients may opt out of marketing emails at any time.
9. Complaints and Dispute Resolution
Client Complaints: If clients have any complaints or concerns during the tour, they must notify the tour guide or Paradise Vacations staff immediately so that we can resolve the issue promptly.
Dispute Resolution: Any unresolved complaints will be handled in accordance with Kenyan law, and clients agree to attempt to resolve disputes amicably before pursuing legal action.
10. Changes to Terms and Conditions
Amendments: Paradise Vacations reserves the right to update these Terms and Conditions at any time. Clients will be notified of any significant changes prior to their booking or tour departure.
