1. Definitions
Explore Kruger Park safaris herein after referred to as Explore Kruger Park safaris and the person or persons who have signed the booking form is herein after referred to as the “Client”. Upon signature the client agrees to be bound by these booking conditions and any contract between the client and Explore Kruger Park safaris is subject to and shall be governed and construed according to South Africa law.
2. The Booking
2.1. A signed and completed booking form must be sent to Explore Kruger Park safaris or its agent together with a non-refundable deposit of 20% of the tour price. The balance of the tour fare is to be paid 28 working days prior to the date of departure.
2.2. Explore Kruger Park safaris will not accept any booking where the booking form has not been signed or is incomplete. Once Explore Kruger Park safaris are in receipt of a signed booking form, plus 20% deposit, a confirmation will be issued. It is only at this time the booking will be deemed for acceptance. Explore Kruger Park safaris reserves the right to decline any booking.
2.3. All prices and services are correct at the time of printing and Explore Kruger Park safaris reserve the right to change all prices, services and departures without prior notice. Once a booking has been made and the full cost paid, Explore Kruger Park safaris will not increase the price.
3. Travel Insurance
3.1. Comprehensive travel insurance for loss of baggage, money or personal items is recommended.
3.2. The client accepts that it is his/her responsibility to arrange insurance.
4. Full payment of Tour Cost
Full payment of tour cost is due 28 working days prior to departure. If full payment is not received by this time Explore Kruger Park safaris may treat the booking as cancelled. Any bookings made within four weeks of departure must be accompanied by full payment of the tour cost.
5. Cancellation or changes to Bookings
5.1. Cancellation of any booking must be received in writing and acknowledged by Explore Kruger Park safaris
5.2. In the event of cancellation the following cancellation fees will be payable by the client:
Notification is received 28 days or more before departure, loss of 20% deposit.
28 -21 working days, loss of 50% of cost
20 -14 working days, loss of 80% of cost
13 - 0 working days, loss of 100% of cost
5.3. If you fail to join a tour. Join it after its departure, or leave it prior to its completion, no reimbursement whatsoever will be made.
5.4. If you need to change your reservation for whatever reason, Explore Kruger Park safaris will make every effort to assist you. You may move your reservation to another date, subject to availability and agreement with our reservation office. Any changes will incur a fee of ZAR 500 and any subsequent cancellation fee will be based on date of original travelling date. Should we not be able to help you with alternative dates, the normal cancellation fees will apply.
6. Passport, visas and other travel documents
6.1. The client is responsible for ensuring that all documents, passport, visas and health certificates are valid.
6.2. The client accepts full responsibility for obtaining all the relevant travel documents required.
6.3. Should a client be refused entry to any country due to incorrect documentation, Explore Kruger Park Safaris will not be liable for any costs of such delays or repatriation cost for the client.
7. Baggage
All personal effects and baggage are at all times the client's responsibility and Explore Kruger Park safaris will not accept liability for any loss or damage to baggage or personal effect.
8. Health
8.1. It is the responsibility of the client to consult a health professional with respect to recommended and compulsory vaccinations and health pre-cautions. Any pre-existing medical condition must be declared at the time of booking and the client must make arrangements for the provision of drugs or other treatment that may be required during the tour.
8.2. Anti-malaria precautions are recommended for all tours and clients are advised to bring insect repellent.
9. Force Majeure
Unforeseen circumstances including weather, road conditions, war, mechanical breakdowns, riots and other reasons beyond the control of Explore Kruger Park safaris may cause delays or alterations to the tour. In the event of any of the aforementioned occurring, Explore Kruger Park safaris shall not be held liable in any way for any resulting costs of these delays or alterations.
10. Exclusion of Liability
10.1. Client’s bookings are accepted on the understanding by the client that all the tours are of an adventurous nature and involve an element of personal risk that is an inherent part of travel in Africa.
10.2. Clients undertake all tours entirely at their own risk and while Explore Kruger Park safaris take every precaution to ensure the safety of the clients, no responsibility can be accepted for any death, injury or loss that might occur to such clients, sustained from any cause what so ever.
10.3. The client and his/her dependants, heirs, executors, administrators or assigns, hereby indemnify and hold blameless, Explore Kruger Park safaris, its shareholders, employees, representatives and agents from any claims of whatsoever nature and from any liability for delay, loss, damage, injury, illness or death arising from any cause whatsoever out of the events related to or occurring during a tour.
10.4. The client agrees to strictly abide by the laws and regulations of the country.
10.5. Clients are responsible for checking in on time and are responsible for reconfirming flight times. Explore Kruger Park safaris cannot be responsible for delays caused by airline flight alterations, cancellations or delays.
10.6. When you book excursions not operated by Explore Kruger Park safaris, whether recommended by the company or not. Explore Kruger Park safaris will have no legal liability for problems arising from the excursion and any claim will be against the relevant local operator.
11. Photography
Explore Kruger Park safaris reserves the right to make use, without giving any further notice, of any photograph or film produced by Explore Kruger Park safaris without payment or permission.
12. Loss or Theft
Personal security is important therefore Explore Kruger Park safaris always advise clients to lock rooms and remove any valuable items from vehicles. Please note that Explore Kruger Park safaris cannot be held responsible for any theft or loss of any personal items and belongings for the duration of the tour.
13. Complaints
If the client has a complaint whilst on tour they must bring it to the guide’s attention, so that it can be dealt with immediately. If the matter isn’t resolved whilst on tour, the clients must write to Explore Kruger Park safaris within 30 days of completion of the tour. Explore Kruger Park safaris will not entertain complaints of loss of enjoyment where full land arrangements have been provided.
