Terms and Conditions
1. Introduction
Welcome to Mesmerize Africa. These Terms and Conditions govern your use of our services and website, as well as your booking of any safaris, tours, or related services through us. By making a booking with Mesmerize Africa, you agree to be bound by these Terms and Conditions.
2. Booking and Payment
• Booking Confirmation: A booking is confirmed when we receive a deposit or full payment, and you receive a confirmation email from Mesmerize Africa.
• Deposit: A non-refundable deposit of 30% is required to secure your booking. The remaining balance must be paid 5 days before the start of the safari.
• Payment Methods: We accept payments via bank transfer, credit/debit card, or other approved payment methods as specified on our website.
• Currency: All payments must be made in USD or another currency specified by Mesmerize Africa.
3. Cancellation and Refund Policy
• Cancellation by the Client: Cancellations must be made in writing. The following charges apply:
o More than 15 days before the safari: 10% of the total cost.
o Less than 5 days before the safari:25% of the total cost.
• Cancellation by Mesmerize Africa: We reserve the right to cancel any booking due to unforeseen circumstances. In such cases, clients will receive a full refund or the option to rebook for a later date.
• Refunds: Refunds will be processed within 10 days of receiving the cancellation request. Any bank charges or payment processing fees will be deducted from the refund amount.
4. Amendments by the Client
• Changes to the Booking: If you wish to make changes to your booking, please notify us as soon as possible. We will accommodate changes where possible, but additional charges may apply.
• Changes by Mesmerize Africa: We reserve the right to make minor changes to the itinerary or services due to operational, weather, or other unforeseen reasons. Significant changes will be communicated, and alternative arrangements will be offered.
5. Travel Documents
• Passports and Visas: It is your responsibility to ensure that you have a valid passport, visas, and other necessary travel documents. Mesmerize Africa is not responsible for any delays or issues arising from incomplete or invalid travel documents.
• Vaccinations and Health Requirements: Clients are responsible for obtaining the necessary vaccinations and meeting any health requirements for travel to the safari destination.
6. Insurance
• Travel Insurance: Comprehensive travel insurance is mandatory for all clients. The insurance should cover medical expenses, trip cancellation, lost luggage, and personal liability.
• Responsibility: Mesmerize Africa is not liable for any loss, damage, or injury incurred during your safari. Clients are advised to obtain insurance that covers these risks.
7. Liability
• Limitation of Liability: Mesmerize Africa will not be liable for any indirect or consequential loss, damage, or injury. Our liability is limited to the amount paid by the client for the safari.
• Third-Party Services: We are not responsible for the actions, errors, or omissions of third-party providers, including airlines, hotels, and transport companies.
8. Force Majeure
Mesmerize Africa will not be liable for any failure to perform our obligations where such failure is due to events beyond our reasonable control, including but not limited to natural disasters, strikes, war, or other unforeseen events.
9. Complaints
• Reporting Issues: Any complaints or issues must be reported immediately to the tour leader or guide. If the issue is not resolved, clients should submit a formal complaint in writing within any days of the safari’s end.
• Resolution: We will make every effort to resolve complaints in a fair and timely manner.
10. Governing Law
These Terms and Conditions are governed by the laws of Tanzania. Any disputes arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Tanzania.
11. Amendments to Terms and Conditions
Mesmerize Africa reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of significant changes before they come into effect.
